OnlineGroups.net terms of service
The following agreement applies to those running and
using an OnlineGroups.net site (the service).
The agreement is between you (The User) and
If The User is a non-business consumer in New Zealand,
then The User has all the rights provided by the
Consumer Guarantees Act.
OnlineGroups.net may interrupt service to perform
OnlineGroups.net will make a best effort attempt to
notify The User of such interruptions.
In the case of unexpected interruption of service,
due to system failure, OnlineGroups.net will provide
its best efforts to repair the system as quickly as
OnlineGroups.net will take all reasonable measures to
provide a high level of service, however The User
agrees to waive any claim to compensation due to
service interruption, whether planned or unplanned,
even if the interruption could have been avoided.
The User agrees that OnlineGroups.net may disable
their account or restart services run by The User (at
OnlineGroups.net's option) if OnlineGroups.net
decides that The User is utilising a high level of
RAM, CPU, or storage that exceeds the level that is
being charged for.
OnlineGroups.net may provide a backup service as an
incidental benefit to their customers. The User
agrees that they are ultimately responsible for
backing up their own site information, including any
data, unless a separate backup agreement with
OnlineGroups.net is in place.
The User agrees that OnlineGroups.net is not liable
for the loss of information due to hardware failure,
software failure, misconfiguration, breach of
security or any event that is within or beyond the
control of OnlineGroups.net.
For users outside New Zealand, The User agrees that
OnlineGroups.net is not liable for the
mis-distribution of information due to hardware
failure, software failure, misconfiguration, breach
of security or any event within or beyond the control
The User agrees to allow content hosted on
OnlineGroups.net servers to be stored by
OnlineGroups.net in any location OnlineGroups.net
deems reasonable for the purposes of distribution,
replication or backup. The User additionally gives
OnlineGroups.net licence to store content for the
purpose of backup even after The User no longer holds
The User agrees to be the primary source of support
for the members of any groups that The User
The User agrees to use the group
Administrators" as the primary source of support
for the service.
OnlineGroups.net reserves the right to change these
terms of service at any time, without notice.
Limitation of liability
IF THE USER IS A BUSINESS, OR OUTSIDE NEW ZEALAND, THEN
THE SERVICES ARE PROVIDED ON AN "AS IS" BASIS AND THE
USER'S USE OF THE SERVICES IS AT THEIR OWN RISK.
ONLINEGROUPS.NET DOES NOT MAKE, AND HEREBY DISCLAIMS,
ANY AND ALL OTHER EXPRESS OR IMPLIED WARRANTIES,
INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
NON-INFRINGEMENT, AND TITLE, AND ANY WARRANTIES ARISING
FROM A COURSE OF DEALING, USAGE OR TRADE PRACTICE.
ONLINEGROUPS.NET DOES NOT WARRANT THAT THE SERVICES
WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY
